Seller Agreement

1. Recitals

Consignor owns trading cards and wishes to have them sold via Consignee’s consignment service (e.g. eBay, other platforms). Consignee agrees to list and sell the cards on behalf of Consignor under the terms below.

2. Items & Ownership

Consignor warrants that they fully own the cards being consigned, free from encumbrances. Ownership remains with Consignor until each item is sold or otherwise disposed of.

3. Delivery & Risk of Loss

Consignor is responsible for safely packaging and shipping items. If an item is lost or damaged in transit, Consignor assumes full responsibility, and must contact the shipping provider (USPS, FedEx, UPS, etc.) to file any claims. Consignee shall not be liable for items lost before physical receipt.

4. Listing & Pricing; No Return of Decision

  • Once received, Consignee may list the cards on pre‑determined platforms.

  • Consignor acknowledges that market value may differ from their expectations, and items may sell for less or more than estimated.

  • Once Consignee receives the items and begins listing, Consignor may not revoke or alter the listing decision or withdraw the items unless mutually agreed in writing.

5. Term & Unsold Items

  • Each shipment initiates a separate Agreement. The term ends when all items sell, six (6) calendar months after receipt, or when terminated by either Party with written notice.

  • Unsold items may be returned to Consignor upon written request at Consignor’s expense, or otherwise disposed of per agreement.

6. Fees & Payment

  • Consignment Fee: 5% of the net sale price, after any platform or processing fees are deducted (e.g. eBay/PayPal fees).

  • Payments are made weekly after sale completion and receipt of funds.

7. Duties of Consignee

  • Use reasonable commercial effort to list, promote, and sell the items.

  • Accurately report all sales, fees, and payouts.

  • Maintain records and provide reporting to Consignor upon request.

  • Store items securely until sold or returned.

8. Representations & Warranties

Consignor represents that the cards are authentic, unaltered, not trimmed, and that all relevant grading or condition information is disclosed. The failure to disclose condition issues may result in claims or reversal, which remain Consignor's responsibility.

9. Limitation of Liability

Consignee is not liable for any indirect, incidental, or consequential loss – except for gross negligence or willful misconduct.

11. General Provisions

  • Severability: If any provision is held invalid, the rest remains in force.

  • Notices: All notices must be in writing and delivered by email or certified mail.
